<p class="p2"><b>Bio: Xavier Ochoa<br />
</b>Xavier Ochoa is a mining engineer with close to 30 years of broad professional, multi-disciplinary experience in the precious metals and copper industries, gained through his involvement in several world class open pit and underground mines. He has a proven track record successfully managing all stages and levels of mining operations, including C-level management, mineral exploration, social and environmental impact studies, engineering studies, project management (e.g., developing/constructing, commissioning) and steady state operations. Mr. Ochoa holds a BSc in Mining Engineering from University of Arizona, as well as various professional certifications.</p>
<p><b>Bio: Andrea Brickey<br />
</b>Dr. Andrea Brickey is the past president of MMSA, a professor of Mining Engineering and Management and the Director of the Office for Professional Education at the South Dakota School of Mines and Technology. She obtained her BS degree in Mining Engineering from South Dakota Mines and her PhD in Mining Engineering from Colorado School of Mines. Prior to her career in academia, she held multiple roles in the mining industry, focused primarily on mine feasibility and design at numerous operations and projects around the world for various commodities. At South Dakota Mines, she conducts research and teaching activities and delivers several mining-specific professional development programs for mineral industry partners.</p>

<p><strong>Webinar Purpose: </strong>Large mining and infrastructure projects are particularly vulnerable to cost overruns and schedule delays. “Failure” may not necessarily result in a total loss, but rather a level of significant underperformance that reduces stakeholder returns. Most risks can be managed or even avoided by owners and lenders when: 1) comprehensive, independent due diligence is conducted by the right expertise(s) before funding and 2) independent monitoring is carried out during project execution by the right expertise(s). This presentation will highlight common root causes of project underperformance and share lessons learned from a recent mining project in Brazil that ended in liquidation and near-total loss for senior lenders.</p>

</b>Justin Norman is a Managing Director in the Construction, Projects &amp; Assets practice at FTI Consulting and has over 25 years of experience in the development and delivery of large-scale heavy industrial and infrastructure projects globally with specific expertise in mining and metals. Justin is an expert in matters related to capital project management best practices, construction management, risk management and project controls. His project services include due diligence and project-readiness reviews; execution-stage gate reviews; project performance assessments; independent engineering and monitoring services for lenders; execution planning; cost and schedule forecasting; and interim project management. In addition to project advisory work, Justin is experienced in evaluating quantum and delay claims in dispute matters, providing expert reports, and testifying in arbitration. Prior to consulting, he worked 18 years for Bechtel’s mining and metals division on process plant and infrastructure projects in North and South America, EMEA, and APAC with leadership roles in project controls, construction, and project management. Justin holds a B.S. in Building Construction from the Georgia Institute of Technology and certifications in project management, construction management, project cost control, scheduling, and process improvement.</p>

<p><strong>Webinar Purpose:</strong> The Good Samaritan Remediation of Abandoned Hardrock Mines Act of 2024 was signed into law on December 17, 2024. The U.S. Environmental Protection Agency (EPA) is developing a Good Samaritan mine cleanup program to implement a new, more efficient strategy to address abandoned hardrock mines. EPA’s December Good Sam webinar is for all interested parties – private, public, State and local governments, Tribes, and non-governmental organizations. EPA will cover the scope of the legacy abandoned mine problem in the US, highlight key aspects of the law, discuss the program’s permitting process and NEPA review, and explain the program’s goals and implementation timelines.</p>

<p class="p2">Mining companies registered with the SEC have been required to comply with Regulation S-K 1300 for their annual reports covering fiscal years ending on or after January 1, 2021. Consequently, most mining registrants filed their first S-K 1300 compliant disclosures in 2022. The US Securities &amp; Exchange Commission (SEC), as part of its disclosure review program, has been issuing comment letters in response to these filings.</p>
